Terms of Service

1. Membership Payments 

I hereby acknowledge and understand that my membership will be due on my signup date every month and that I will be automatically billed for my membership using the provided payment option. I also understand that in order to cancel my membership, I shall provide 1RM Strength Inc. with a minimum of 1 month notice in order to process cancellation prior to commencement of next payment. 

2. Access ‍

1RM Strength Inc. reserves the right to immediately terminate your use of, or access to the premises at any time if 1RM Strength Inc. decides at its sole discretion that you have breached this Agreement or any relevant law, rule or regulation or you have engaged in conduct that 1RM Strength Inc. considers to be inappropriate or unacceptable. I hereby understand that my membership constitutes access to 1RM Strength Inc. at certain hours and that if I am entering 1RM Strength Inc. at hours that are not allowed by my membership, that I am stealing services and am liable for termination. I also understand that if I am allowing another individual into the premises with my key that I am "tailgating" and stealing services from 1RM Strength Inc. and my membership will be terminated immediately. The membership is personal, and cannot be shared. I understand that I am 18 years old or older. For persons 16 or 17 years old, exceptions are granted based on a written parental consent. 

1RM Strength Inc. reserves the right to camera surveillance on the premises for safety and security purposes.

3. Rules and Regulations 

The member shall respect the behavioral and operating principles on all occasions. The member shall read and be aware of all rules and regulations prior to commencing access to the premises. 

This includes, but is not limited to: 

  • Wearing appropriate and clean clothes and shoes. 
  • Using a towel at every workout. Disinfecting and leaving machines and surfaces clean after usage.
  • Behaving in a friendly and respectful manner towards the other members in the gym as well as the staff. 

1RM Strength Inc. does not take responsibility for loss or theft of any personal belongings. Any claims of loss or theft will be investigated thoroughly via security camera. 

I hereby acknowledge that I have read and understood the rules and regulations as provided by 1RM Strength Inc.

‍4. Release of Liability 

While 1RM Strength INC. does its best to ensure the optimal safety of the consumer, you agree that you use these services and rely on material contained within the premises at your own risk. To the maximum extent permitted by law, the premises, and all materials on the premises, are provided "as is" and, to the fullest extent permitted by law, are provided without warranties of any kind either express or implied. You acknowledge that 1RM Strength Inc., its parents and affiliates together with their respective employees, agents, directors, officers and shareholders, ARE NOT LIABLE for any delays, inaccuracies, failures, errors, omissions, interruptions, deletions, defects, viruses, or for the theft, destruction, damage or death of person or personal property. 

You acknowledge that 1RM Strength Inc. is not liable for any defamatory, offensive or illegal conduct or material found in connection with these premises, including such conduct or material transmitted by any means by any other person. 

You acknowledge that 1RM Strength Inc. is not liable for any damages, including, without limitation, direct, incidental, special, consequential or punitive damages, in connection with or arising from your use or from your inability to use the premises.

5. Indemnity

You agree to defend, indemnify and hold harmless 1RM Strength Inc., its parents and affiliates, employees, agents, directors, officers and shareholders, from and against all the liabilities, claims, damages and expenses (including reasonable attorney's fees and costs) arising out of your use of these premises; your failure to use the premises; your breach or alleged breach of this Agreement or your breach or alleged breach of the copyright, trademark, proprietary or other rights of third parties.

6.Health: 

I hereby confirm that I do not suffer from health problems that would hinder exercise or prevent me from engaging in exercise, or that would be detrimental or adverse to my health, safety or physical condition if he/she did exercise. In case of any doubt, I shall seek advice by a medical doctor who should confirm the ability to exercise. 1RM Strength Inc. shall have no obligation to perform a fitness assessment or similar testing to determine members physical condition. I release all liability of 1RM Strength Inc., its parents and affiliates, employees, agents, directors, officers and shareholders in the event of any pandemic related illness such as COVID-19. I agree to enter the premises at my own risk and accept all responsibility in the event of illness.

7. 1RM Strength Inc. COVID-19  Release of Liability

The 1RM Strength Inc. COVID-19 Release of Liability ("Rules") below is hereby immediately enacted by 1RM Strength Inc. as a preventative measure to protect the health & safety of all Members and Participants at 1RM Strength Inc. due to the extent possible due to health risks arising from the worldwide pandemic of COVID-19, also known as the Coronavirus and its variants. 

Due to COVID-19, older adults and people of any age who have serious underlying medical conditions might be at higher risk for severe illness from COVID-19. 1RM Strength Inc. has requested any Member or Participant who falls within any of the high-risk categories as set forth on the Center for Disease Control website to refrain from attending or participating at 1RM Strength Inc. unless fully vaccinated. here: https://www.cdc.gov/coronavirus/2019-ncov/need-extra-precautions/groups-at-higher risk.html It is commonly known and universally accepted that being in the presence of others as part of a group, despite efforts at social distancing, can result in the contracting of COVID-19. 

"Participant" shall be defined as any member, coach, staff member, trainer, volunteer, support personnel or attendee. If any Participant chooses to be present at and/or participate in any 1RM Strength Inc. event or competition, then each such Participant shall do so at their own risk. Each Participant knowingly, willfully, and voluntarily assumes this known risk when present at or participating 1RM Strength Inc. events. Participant agrees to adhere to the following rules: 

  • Gym is open to members and employees only. 
  • Visitors who are not Participants may not attend unless allowed by state or local ordinance.
  • Members must wipe down all equipment once they have finished using the equipment.
  • Members and all Participants should use hand sanitizer prior to handling equipment.
  • Participants should bring their own bottled water; Public drinking water sources may be turned off and unavailable.
  • Do not share personal gear. 
  • Comply with all CDC recommended social distancing guidelines, including wearing a mask at all times at any event or competition where mandated by state or local ordinance. CDC guidelines are available here:

  • If you do not feel well, stay home. IF WITHIN 14 DAYS OF ATTENDING ANY 1RM Strength Inc. EVENT OR COMPETITION YOU SUSPECT YOU HAVE CONTRACTED COVID-19, IMMEDIATELY CALL 1RM Strength Inc. IF YOU LEARN THAT YOU HAVE BEEN IN CONTACT WITH SOMEONE WITH COVID-19 DURING THE 14 DAYS PRIOR TO ATTENDING 1RM Strength Inc., IMMEDIATELY CONTACT 1RM Strength Inc. support@onermstrength.com 
  • DO NOT ATTEND IF YOU:
  • Are exhibiting any symptoms of the coronavirus: mild to severe respiratory illness with fever, cough and difficulty breathing, or other symptoms identified by the CDC.
  • Have been in contact with someone with COVID-19 in the last 14 days.
  • Are a high risk or vulnerable individual as described above. Please use safety and sanitizing measures when utilizing the facilities.
